Owning a Firearm for Home Defence: Law, Storage and Responsibility

A firearm is the last layer of home security, never the first. Brazil and the US treat it very differently. Know the law before anything else.

Deciding to keep a firearm at home is a legal, moral and practical decision, not a shopping one. Security professionals place it at the very end of the plan. The first goals are always to avoid a confrontation, get the family to safety and call the police. Public-health research also links access to a firearm at home with higher risks of accidents and suicide. If, after weighing all that, you decide to own one, the law and responsible habits define everything that follows.

Brazil: posse is not porte

  • The framework is Law 10,826/2003, the Estatuto do Desarmamento, regulated by Decree 11,615/2023. Posse allows a registered firearm inside your home, or at your workplace if you are its owner or legal manager. Porte, carrying it in public, is prohibited as a rule and authorised only in exceptional cases.
  • To acquire a firearm, the Federal Police requires, among other things: minimum age of 25, a declaration of effective need, clean criminal records, lawful occupation and fixed address, and certified technical capacity and psychological aptitude from professionals accredited by the Federal Police.
  • The firearm must be registered with the Federal Police after purchase. Since July 2025 the Federal Police, not the Army, also oversees hunters, sport shooters and collectors (CACs).
  • Article 13 of the Estatuto makes it a crime to fail to take the necessary precautions to prevent a person under 18, or a person with a mental disability, from getting hold of a firearm you own or possess.

United States: fifty different answers

  • The Supreme Court recognised an individual right to keep a handgun at home for self-defence in Heller (2008) and set a history-based test for gun laws in Bruen (2022). States still differ widely on permits, purchase rules, carry and storage.
  • Federal law requires licensed dealers to run background checks through the national NICS system.
  • Many states and some cities have child-access prevention or safe-storage laws. Check the law where you live and in every state you travel through.
Owning a firearm is not a security plan. It is a responsibility that begins with the law and never ends.
The real work happens with a lawyer and a certified instructor, long before any purchase.

Storage, training and insurance

  • Store firearms unloaded and locked in a safe or lockbox, accessible only to authorised adults, and follow what local law requires for ammunition.
  • Keep keys and codes away from children. Teach them a simple rule: do not touch, leave the room, tell an adult.
  • If anyone at home is going through a crisis, consider temporary storage outside the home and seek help: in Brazil, CVV on 188; in the US, call or text 988.
  • Train with a certified instructor, including the law of self-defence and de-escalation. In Brazil, self-defence is defined in Article 25 of the Penal Code.
  • Ask your insurance broker whether your home and liability policies cover firearm theft and incidents.

Before any decision, talk to a lawyer who knows firearm law in your jurisdiction and to a certified instructor. Rules change, and the responsibility is always yours.

Key takeaways

  • Every earlier layer, from locks to safe room, comes before a firearm.
  • In Brazil, posse allows a registered firearm at home; porte, carrying it, is the exception.
  • In the US, permits, carry and storage rules vary by state and city.
  • Locked storage, certified training and legal advice are not optional.

FAQ

What is the difference between posse and porte in Brazil?

Posse allows you to keep a registered firearm inside your home or business you own or manage. Porte allows carrying it outside and is granted only in exceptional cases by the Federal Police.

What is the minimum age to own a firearm in Brazil?

According to the Federal Police, 25 years, in addition to other requirements such as effective need, clean records, technical capacity and psychological aptitude.

Is safe storage a legal requirement?

Often, yes. Brazil's Estatuto punishes failing to prevent minors from accessing a firearm, and many US states have safe-storage laws. Check your local rules with a lawyer.
